Сфера криптовалют, как молодой и динамичный рынок, характеризуется отсутствием полноценного государственного регулирования. Это привело к процветанию теневого сектора майнинга, что, в свою очередь, создает проблемы с энергодефицитом в регионах и уменьшает налоговые поступления в бюджет на десятки миллиардов рублей ежегодно.
Государственная Дума готовится к принятию законопроекта, инициированного «Единой Россией», который призван установить правовое поле для деятельности по майнингу и сделать эту сферу прозрачной. Законопроект предусматривает следующие нововведения.
Вводятся четкие определения ключевых терминов, таких как «майнинг цифровой валюты», «майнинг-пул», «оператор майнинговой инфраструктуры». Устанавливается перечень видов деятельности, которые рассматриваются как организация оборота цифровой валюты в России.
Запрещается реклама цифровых валют и организация их оборота, за исключением деятельности по майнингу. Вводится запрет на обращение цифровой валюты, полученной в результате майнинга, с использованием объектов, не отнесенных к российской информационной инфраструктуре.
Правительство получает право устанавливать требования к майнинг-пулам, вводить запреты на майнинг в отдельных регионах, регулировать деятельность операторов майнинговой инфраструктуры. Вводятся требования к деятельности физических и юридических лиц, занимающихся майнингом, согласованные с Банком России. Контроль за соблюдением законодательства возлагается на Роскомнадзор.
Юридические лица и индивидуальные предприниматели смогут заниматься майнингом только после включения в специальный реестр. Физические лица смогут майнить без включения в реестр, если их потребление энергии не превышает установленные лимиты.
Индивидуальные предприниматели и юридические лица, учредители или руководители которых имеют неснятую или непогашенную судимость за преступления в сфере экономики, преступления против государственной власти или умышленные преступления любой категории (кроме небольшой тяжести), не смогут заниматься майнингом.
Лица, занимающиеся майнингом, обязаны предоставлять информацию о полученной цифровой валюте и уникальном идентификаторе (адресе) для учета операций. Росфинмониторинг ведет список идентификаторов, в отношении которых есть подозрения в отмывании денег, финансировании терроризма или связи с преступной деятельностью.
Предполагается, что принятие этого законопроекта сделает сферу криптовалют более прозрачной и управляемой, а также создаст дополнительные возможности для обхода западных санкций.
Законопроект будет рассмотрен во втором и третьем чтениях в ближайшее время.
